General Terms and Conditions (GTC) for Customers of top-offerten.ch
top-offerten.ch, a business division of top-offerten GmbH, Im Rötler 33, 8583 Donzhausen TG (Switzerland)
Version of 28 October 2026
Part A: Inquiries and Use of top-offerten.ch
1. Scope and Roles
- top-offerten.ch forwards inquiries from private individuals and companies (hereinafter customers) for services such as relocation, cleaning, disposal or trade work to registered service companies (hereinafter partners). Part A of these GTC applies to any use of top-offerten.ch, other websites of top-offerten GmbH and the customer area, in particular for inquiries, messages and reviews.
- Part B applies in addition when a customer books a relocation directly with a partner through the «Sorglos Umzug» offer.
- top-offerten.ch is not a party to the contracts between customer and partner and does not itself provide the services inquired about or booked. The partner alone is responsible for the content and performance of these contracts, unless these GTC provide otherwise. The partner may engage subcontractors only with the prior consent of the customer and of top-offerten.ch; it remains responsible for their performance.
- Purchases in the webshop are governed by the General Terms and Conditions of top-offerten GmbH, Part II (Webshop).
2. Inquiry
- The inquiry is free of charge and non-binding for customers. It does not oblige the customer to place an order.
- top-offerten.ch forwards the inquiry to up to five partners registered for the requested field and area. There is no entitlement to a specific number of quotations or to a quotation within a specific period.
- The partner prepares quotations on its own responsibility. A contract is concluded only when customer and partner agree directly.
- top-offerten.ch requires evidence from the partners (for example commercial register entry, liability insurance, social insurance registration) and verifies it. top-offerten.ch gives no guarantee for the quality of a partner's work or its ability to pay.
3. Customer Obligations
- The customer provides truthful and complete information and states their own contact details at which they can be reached. An inquiry on behalf of another person is permitted only with that person's consent.
- In particular, the following are not permitted: fictitious inquiries, inquiries made to establish contact for advertising, job seeking or other unrelated purposes, sending advertising via the messaging system, and the automated extraction of content and data (for example scraping, bots, crawlers) without the written consent of top-offerten.ch.
- In the event of violations, top-offerten.ch may delete inquiries, block access to the customer area and claim compensation for proven damage.
4. Customer Area and Messages
- Through the customer area, the customer manages their inquiries, quotations, messages and bookings. The customer keeps their access data confidential and informs top-offerten.ch immediately if misuse is suspected.
- Messages between customer and partner are transmitted and stored via the top-offerten.ch system. top-offerten.ch views messages only to the extent necessary for support, for investigating complaints or misuse, or for legal reasons.
- top-offerten.ch endeavors to ensure high availability of the websites and the customer area but cannot guarantee uninterrupted operation.
5. Reviews
- After completion of an order, the customer may review the partner. Reviews must be based on personal experience and be truthful and factual. Insulting, unlawful or unrelated content and personal data of third parties are not permitted.
- The customer grants top-offerten.ch the free, non-exclusive and unlimited-in-time right to publish the review (stars, text, date, first name with the initial of the surname, and place) on top-offerten.ch and other websites of top-offerten GmbH, in particular on the partner's profile, and to use it in advertising for top-offerten.ch (for example in online ads, social media, newsletters and printed materials). For this purpose, top-offerten.ch may shorten or translate the review without changing its meaning. Private messages are not published.
- top-offerten.ch reviews reviews before and after publication and may reject or remove impermissible reviews. The partner may respond publicly to a review.
- The customer may request at any time that their review be deleted. Advertising materials that have already been printed or placed do not have to be withdrawn; new ones are produced without the review.
- If top-offerten.ch refers the customer to a third-party platform to submit a review (for example Google or Trusted Shops), the terms of that third party apply there.
6. Data Protection and Advertising
- top-offerten.ch processes personal data in accordance with the privacy policy. To mediate the inquiry, top-offerten.ch passes the customer's details and contact data on to the selected partners. These then process the data on their own responsibility for preparing quotations and performing orders. For «Sorglos Umzug» bookings, the payment service providers used also receive the data required for payment. top-offerten.ch publishes reviews exclusively on its own websites.
- top-offerten.ch may inform customers by e-mail about its own similar services (for example mediation of cleaning, disposal or moving supplies). The customer may decline this when making the inquiry or booking or at any time afterwards, including via the unsubscribe link in each such e-mail. top-offerten.ch sends advertising for third-party offers only with separate consent. The customer receives necessary notices about the inquiry and booking (for example confirmations and quotation notifications) regardless of any consent. Review invitations designed as advertising are treated in the same way as advertising.
7. Liability of top-offerten.ch
- top-offerten.ch is liable for damage it causes intentionally or through gross negligence. In the case of slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract; otherwise, liability for slight negligence is excluded to the extent permitted by law. Claims for repayment of amounts owed, in particular the down payment, remain unaffected. Liability for personal injury and under other mandatory statutory provisions remains reserved.
- top-offerten.ch is not liable for the services, quotations, statements and conduct of the partners. Part B (in particular section 17) remains reserved.
8. Changes to these GTC
- top-offerten.ch may amend these GTC for the future. Existing inquiries and bookings remain subject, unchanged, to the version that applied when the inquiry was submitted or the booking was made. Changes to rights and obligations in an existing usage relationship apply only with the customer's consent.
9. Governing Law and Jurisdiction
- Swiss law applies, excluding the Vienna Sales Convention (CISG).
- For actions brought by consumers, the court at their place of residence or at the seat of the defendant has jurisdiction; for actions against consumers, the court at their place of residence. For customers who are not consumers, the place of jurisdiction is Weinfelden TG (Switzerland).
- Should individual provisions be invalid, the remaining provisions remain effective.
- These GTC exist in several languages. In case of discrepancies, the German version prevails.
Part B: Booking Terms «Sorglos Umzug»
10. Application and Contracting Parties
- With «Sorglos Umzug», the customer books a relocation directly with a partner (hereinafter moving company) at a price calculated on top-offerten.ch. The moving contract is concluded exclusively between the customer and the moving company.
- top-offerten.ch mediates the booking and acts in doing so in the name of the moving company: it receives the booking, confirms it and collects the down payment (section 13).
- These booking terms form part of the moving contract. They take precedence over the general terms and conditions of the moving company. The moving company's terms apply only in addition, only to the extent that they were made available to the customer before booking and only to the extent that they do not conflict with these booking terms. Individual agreements between customer and moving company take precedence. The moving company has authorized top-offerten.ch to conclude moving contracts on these booking terms with binding effect.
11. Booking and Conclusion of Contract
- The customer enters their details (in particular furniture list, carrying distances, floors, moving boxes and additional services). From this, top-offerten.ch calculates a price for available moving companies and dates and displays the scope of services, price, date and moving company.
- Before booking, the customer is shown the fixed price, possible adjustment range (±10 %), down payment and cancellation terms; the customer confirms having read these booking terms. By clicking the button to book with a 10 % down payment and paying the down payment, the customer makes a binding booking. The contract is concluded with the booking confirmation by e-mail. A later confirmation by the moving company serves only organizational purposes and does not call the contract into question.
- If the moving company does not confirm the order in time or cannot perform it, top-offerten.ch shows the customer, where possible, other available moving companies for the same scope of services and date, with their prices. If the customer selects one of them within 48 hours (within 24 hours for a move in less than 5 days), the contract is concluded with that company at its displayed price; the down payment already paid is credited. If the customer selects no company, this does not count as cancellation; section 16 applies.
12. Price and Scope of Services
- The displayed price covers the services listed in the booking and includes value-added tax if the moving company is subject to value-added tax.
- The price is a fixed price based on the customer's information. It includes the mediation fee of top-offerten.ch; the customer owes no additional mediation fee. It can only be adjusted if the actual conditions on site differ from the information provided, and then by no more than 10 % upwards or downwards. Adjustments are based on proven additional or reduced effort at the rates on which the price calculation was based; the moving company explains them on its invoice.
- Beyond 10 %, the price may change only if
- the customer has demonstrably provided essential information that was incorrect or incomplete and additional effort results (for example significantly more furniture or boxes, longer carrying distances, no elevator);
- the customer requests additional services; or
- unforeseeable circumstances beyond the moving company's control occur (for example an official road closure).
- Up to 10 days before the moving day, the customer may adjust their furniture list in the customer area. The price is recalculated at the rates that applied at the time of booking. The new price is displayed and applies only once the customer has confirmed it. After that, changes are possible only in agreement with the moving company.
13. Down Payment and Payment
- At the time of booking, the customer pays a down payment of 10 % of the price using the payment methods offered (for example credit card or TWINT). top-offerten.ch collects the down payment in the name of the moving company. The moving company has authorized top-offerten.ch to receive the down payment with discharging effect; by payment to top-offerten.ch, the down payment is deemed paid to the moving company. top-offerten.ch retains the down payment as the moving company's mediation fee.
- The down payment is credited against the price. The remaining amount corresponds to the final price less the down payment made. The moving company invoices it directly to the customer after performance. It is payable in accordance with that invoice. The moving company may not demand any further advance payments.
- Refunds of the down payment (sections 15 and 16) are made via the original payment method or by bank transfer.
14. Customer Cooperation
- The customer ensures that the moving company has access to the place of departure and the place of arrival on the moving day. Where necessary, the customer arranges for a stopping or parking option near the entrance; the customer bears the costs of official permits unless they are booked as a service.
- Without a booked packing service, moving boxes must be fully packed and sealed when work begins. The customer transports cash, jewelry, securities, important documents and hazardous substances themselves.
- The customer or a person appointed by them can be reached during the move and is present at the start and at completion.
- If the customer breaches these obligations and the moving company incurs additional effort as a result (for example waiting time), it may charge for this in accordance with section 12.3.
15. Cancellation and Rescheduling by the Customer
- The customer may cancel the booking at any time in the customer area or by e-mail to info@top-offerten.ch. The time at which the cancellation is received is decisive.
- In the event of cancellation, the customer owes the moving company the following compensation, calculated on the price according to the booking (calendar days before the moving day):
- 30 days or more: no compensation, the down payment is refunded in full;
- 20 to 29 days: 10 % (the down payment is retained);
- 2 to 19 days: 60 %;
- the day before or on the moving day: 85 %.
- The down payment is credited against the compensation. If the compensation exceeds the down payment, the moving company invoices the difference directly.
- The amounts under section 15.2 are maximum amounts. The customer may prove that the moving company suffered no damage or lesser damage; saved expenses and replacement orders are taken into account. The compensation is then reduced accordingly; if it is lower than the down payment, the difference is refunded. Mandatory statutory termination rights, in particular Art. 404 of the Swiss Code of Obligations (CO), remain reserved; compensation is owed only to the extent permitted by law.
- Rescheduling is possible only by agreement with the moving company. If no agreement is reached, the customer may cancel in accordance with sections 15.1 to 15.4.
- In Switzerland, there is no statutory right of withdrawal for contracts concluded online. Cancellation is governed by this section; statutory termination rights remain reserved.
16. Cancellation by the Moving Company
- If the moving company cancels a confirmed order or does not perform it, and no replacement solution accepted by the customer under section 11.3 materializes, top-offerten.ch refunds the down payment in full, regardless of any fault on the part of the moving company.
- Further claims of the customer against the moving company remain reserved.
17. Performance, Damage and Defects
- The moving company performs the move carefully and professionally. It is liable in accordance with the statutory provisions, in particular for damage to goods being moved, buildings and fixtures caused by it, its employees or subcontractors. It holds business liability insurance.
- The customer objects to recognizable transport damage and losses upon delivery, ideally on a handover record. Damage that is not recognizable must be reported to the moving company without delay after discovery, at the latest 8 days after delivery, if possible with photos. Statutory exceptions (for example in the case of intent or gross negligence on the part of the moving company) remain reserved. A copy of the report to info@top-offerten.ch is recommended.
- The customer reports defects in cleaning or other additional services to the moving company immediately after discovery; the moving company is given the opportunity to remedy them.
- top-offerten.ch supports the customer in clarifying damage and complaints but does not decide on the moving company's liability.
- top-offerten.ch closes the booking in the system 5 days after the moving day, unless the customer has confirmed or objected to it beforehand. The customer's rights against the moving company remain unaffected.
18. Liability of top-offerten.ch for «Sorglos Umzug»
- top-offerten.ch is liable for correct mediation, price calculation based on the customer's information, payment processing and refund of the down payment in accordance with section 7. The moving company alone is liable for the performance of the move.
